Terms of Service

1. Acceptance

By creating an account or using Dispatch, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Service Description

Dispatch provides AI-powered SMS agents for businesses. We provide dedicated phone numbers, AI-driven message responses, lead capture, and conversation management tools. Messages are delivered via Twilio and processed by Anthropic Claude AI.

3. SMS Messaging Terms

By using Dispatch, you acknowledge and agree to the following SMS messaging terms:

• Consent: You are responsible for ensuring that your customers have provided consent to receive SMS messages before they are sent. Customers who text your Dispatch number first are providing opt-in consent for that conversation.
• Opt-Out: Customers can reply STOP at any time to stop receiving messages. You agree not to send messages to customers who have opted out.
• Message Content: You are responsible for the content of your AI agent's system prompts and configurations. Do not configure agents to send prohibited content including spam, phishing, illegal content, or deceptive messaging.
• Compliance: You agree to comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable federal, state, and carrier regulations regarding SMS messaging.
• Message Rates: Standard message and data rates may apply to end users. Message frequency varies based on conversation activity.
• No Sharing: Phone numbers collected through Dispatch will not be shared with third parties for marketing purposes.

4. Acceptable Use

You agree not to:

• Send unsolicited bulk SMS messages (spam)
• Use the service for illegal purposes
• Impersonate other businesses or misrepresent your identity
• Interfere with the service or other users' access
• Violate carrier messaging policies or regulations

5. Billing

Subscription fees are billed monthly via Stripe. You may cancel at any time. Refunds are handled on a case-by-case basis. Overages beyond your plan's SMS limit may result in additional charges or throttling.

6. AI Disclaimer

Dispatch uses AI to generate SMS responses. While we strive for accuracy, AI responses may occasionally be incorrect or inappropriate. You are responsible for monitoring your agent's conversations and configuring appropriate system prompts and escalation rules.

7. Limitation of Liability

Dispatch is provided “as is” without warranties. Naptown Labs is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue, message delivery failures, or AI response errors.

8. Termination

We may suspend or terminate your account for violations of these terms, particularly for SMS spam or abuse. Upon termination, your data will be deleted within 30 days.
